Can a foreigner buy property in Costa Rica?

It is one of the most common questions. The short answer: yes, and you do not need residency. Here are the details worth knowing.

The same rights as a Costa Rican

A foreigner, even on a tourist visa, can buy and register titled property (with a folio real) in their own name at the National Registry, with the same rights as a citizen. The purchase is signed before a notary like any other (see Buying land or a house in Costa Rica: steps, documents and costs).

The exception: the maritime zone

The 200 meters from the high-tide line are not private property: they are granted as municipal concessions. The law restricts these concessions for foreigners without five years of residency and for companies with majority foreign capital. Titled land behind that strip has no such restriction.

In your own name or through a company?

Many buyers use a company (S.A. or S.R.L.). It can make resale or inheritance easier, but it has costs: the annual corporate tax (in 2026, ₡69,330 for an inactive company, more for an active one), annual filings and the beneficial-ownership registry at the Central Bank. Missing them means fines. Ask a lawyer before deciding.

Buying does not give residency

Owning a home does not grant residency. Only an investment of a certain amount can qualify for investor residency (see Costa Rica residency for foreigners: pensionado, rentista, investor).
